Article 1: General provisions

The ecommerce website of geuzeshop.com provides its customers with the option of buying products from its webshop. These General Terms and Conditions (“Terms”) are applicable to all orders placed by a visitor to this ecommerce website (“Customer”). When placing an order via the webshop of Geuzeshop.com, Customer must explicitly accept these Terms, whereby Customer agrees to the applicability of these Terms with the exclusion of all other conditions. Additional Customer conditions are excluded, except when explicit accepted beforehand in writing by Geuzeshop.com.

Article 2: Age restriction

By placing an order on geuzeshop.com, the buyer confirms that he/she has reached the legal drinking age. Geuzeshop.com is empowered to request proof of identity to ensure the legal drinking age. This empowerment intendeds to protect minors. If the ID request is refused or the legal drinking age condition is not met, Geuzeshop.com will cancel the order. Geuzeshop.com cannot be held responsible for this cancellation.

Article 3: Sensible Use of our Products

Be aware that excessive consumption of alcoholic beverages can be unhealthy. That is why we recommend consuming our products in a well-considered way. Geuzeshop.com is not responsible for any allergic reactions after consuming its products. We are also not liable for any illness or discomfort that may be caused by the products we sell.

Article 4: Price

All prices quoted on Geuzeshop.com are expressed in EURO (€). Geuzeshop.com is subject to the Belgian VAT exemption scheme for small businesses. This involves that stated prices on Geuzeshop.com do not include VAT and there will no VAT be charged on settlement. This applies to both companies and consumers. Prices are valid at the time of publication. We reserve the right to change our prices at any moment in time without further notice.

Prices stated on geuzeshop.com do not include shipping costs. The total shipping cost depends on 1) the destination, 2) the chosen courier and 3) the total weight of the order. Deliveries may be subject to local taxes, excise duties, import duties and customs charges. These costs are fully borne by the customer. Geuzeshop.com can at no time be held liable for these additional costs and the payment thereof.

The specified price refers solely to the articles as set out in writing. The accompanying photos are intended as decorative and may contain elements that are not included in the price.

Article 5: Availability

Despite the fact that our online catalogue and ecommerce website are assembled with the utmost care, it’s still possible that information may be incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the product selection are not binding for Geuzeshop.com. With respect to the accuracy and completeness of the provided information, Geuzeshop.com is solely bound to obligation of means. Geuzeshop.com is in no way liable in event of obvious material or printing errors.

The product selection is valid while stocks last and may at any time be changed or withdrawn by Geuzeshop.com. Geuzeshop.com cannot be held liable for the non-availability of a product. If an offer is for a limited duration or subject to conditions, this will be explicitly stated in the offer.

If, despite careful stock management, an ordered item turns out not to be in stock, Geuzeshop.com will always contact the Customer who will be given the option to change or cancel his order if desired.

Article 6: Online purchases

Geuzeshop.com Customers have the option to create a personal user account to ease the (future) purchase process(es). However, this is not mandatory. If customers nevertheless opt to use a personal user account, they are responsible for the management and confidentiality of their username and associated password that limits access to their account. Owners of a personal user account are at all time accountable for the activities and purchases arising from their account unless it can be demonstrated that access to the account has been unlawfully obtained by third parties.

The delivery of orders made through Geuzeshop.com is not a legally binding agreement. Once you have placed an order using our website, our system will automatically send you an email with an overview of the items you have ordered. This email is only an electronic receipt for receiving your order. You should be aware that the automatic response (via email) is not a legally binding order confirmation where an agreement has been entered into. Geuzeshop.com thus has the opportunity to cancel your order due to printing errors, sold items, technical problems, delivery failures or similar situations. A binding order confirmation will be sent to you in the form of an invoice after we have collected and shipped the items you ordered.

The Customer can choose between the following payment methods: bancontact, creditcard, Apple Pay, KBC/CBC payment button, Belfius Direct Net, PayPal and bank transfer (BE84 7370 5349 7159). We offer these payment methods using our payment provider Mollie. Costs associated with the offered payment methods can be found on the Mollie website: https://www.mollie.com

Geuzeshop.com is entitled to refuse an order pursuant to a serious breach on the part of the Customer with respect to their orders.

Article 7: Delivery and execution of the agreement

The full product range of geuzeshop.com is in stock. Orders before 4:00 pm will be transferred to our courier the same day. Our default couriers are bpost and UPS. The choice is up to the Customer (who can choose the preferred courier at the checkout process of their purchase on Geuzeshop.com). Both couriers ship worldwide. The difference is in the insurance. Orders sent with bpost are insured up to 500EUR for deliveries in Belgium. Outside Belgium, only the shipping costs are insured. UPS deliveries are always insured for the total cart value. Regardless whether the delivery takes place in Belgium or not. For both couriers the insurance covers damage and loss.

When goods are damaged or incomplete at the moment of delivery, the Customer should make a written reservation on the courier’s delivery note. When no reservation has been made, the customer accepts the order and admits that Geuzeshop.com has met it’s obligations. This acceptance involves the fact that from that moment on the goods are the customer’s responsibility. The risk due to loss or damage is transferred to the Customer at the time the goods have been physically received by the Customer (or a third party indicated by the Customer that is not the carrier).

Any visible damage to and/or qualitative deficiencies of an article or other deficiency in the delivery must be reported immediately by the Customer to Geuzeshop.com. The Customer has to send an email to info@geuzeshop.com within 48hrs (2 days) after delivery. This email must contain the ordernumber, pictures of the broken bottles and pictures of the opened box as a whole with the damage as well as the shipping label visible. We do not resend the bottles that were broken but we will refund in the currency of the original order. We do not compensate any currency fluctuations that may occur. The amount of the refund is limited to the insured value of the package.

Delivery time is highly dependent on location. Unless otherwise agreed or explicitly determined otherwise, the goods shall be delivered to the Customer’s residence within 3-10 working days after receipt of the order. In exceptional cases this can take longer. Although we do our utmost to deliver your order as quickly as possible, we cannot accept liability for delays in delivery for any reason.

Geuzeshop.com cannot become responsible if the customer is not at home during the delivery of his package or cannot accept his package for any reason. The postal services will offer the package several times. If due to negligence (such as not picking up your package or not being at home at the agreed time) the package is returned to us, we will not be able to give you a full refund. If bottles are returned to us in perfect condition, we will refund the price paid minus a € 25 administration fee. The paid shipping costs will be irrevocably lost. The refund will be made 14 days after we have received the package. In case that the Customer wants us to resend the same order, the cost of the new shipment and the re-packaging fee will be billed. This new shipment can only be continued if these costs are received by Geuzeshop.com.

Article 8: Retention of title

Delivered articles remain the exclusive property of Geuzeshop.com until the moment the Customer pays for the goods in full. If necessary, the Customer undertakes to inform third parties of the retention of title belonging to Geuzeshop.com, e.g. to anyone who would attempt to seize articles that are not fully paid for.

Article 9: Right of withdrawal

The provisions of this article apply solely to Customers in their capacity as consumers purchasing articles online from Geuzeshop.com. The Customer has the right to withdraw from this agreement within a period of 14 calendar days without giving reasons.

The right of withdrawal period will expire 14 calendar days after the date when the goods were physically received by the Customer or a third party indicated by the Customer that is not the carrier.

To exercise the right of withdrawal, the Customer must notify Geuzeshop.com in an unambiguous statement (e.g. in writing by post, fax or e-mail) about their decision to withdraw from the agreement.

To comply with the withdrawal period, the Customer must send a notification of their decision to exercise the right of withdrawal before the withdrawal period has expired.

In any event, the Customer has no later than 14 calendar days from the day that they notify Geuzeshop.com of their decision to withdraw from the agreement to send back or hand over the goods to Geuzeshop.com. The Customer is on time if they have sent back the goods before the period of 14 calendar days has expired.

The direct costs for returning the goods shall be borne by the Customer.

If the returned product is reduced in value in any way, Geuzeshop.com is entitled to hold the Customer liable and demand compensation for each depreciation in value of the goods that are due to the Customer’s use of the goods that goes beyond what is necessary in order to determine the nature, characteristics and operation of the goods.

Only articles that are returned in the original packaging, along with all accessories, instructions and invoice or sales receipt can be returned.

If the Customer withdraws from the agreement, Geuzeshop.com shall repay all payments received from the Customer up until that time including standard shipment costs with a maximum of 14 calendar days of the date that Geuzeshop.com was notified by the Customer of their decision to withdraw from the agreement. For sales agreements, Geuzeshop.com may wait on the reimbursement until all the goods have been sent back, or until the Customer has demonstrated that he has sent back the goods, whichever is earliest.

Any additional costs resulting from the Customer choosing another form of delivery other than by the cheapest standard delivery offered by Geuzeshop.com will not be refunded.

Geuzeshop.com shall repay the Customer using the same means of payment as the Customer used in the initial transaction, unless the customer explicitly agreed otherwise. In any case, the Customer will not be charged any costs in connection with such repayment.

If the customer decides to refuse the order due to customs charges, geuzeshop.com reserves the right to deduct the initially paid shipping costs from the refund.

Article 10: Customer service

Article 11: Penalties for non-payment

Without prejudice to the exercise of any other rights that Geuzeshop.com is entitled to, the Customer owes interest at a rate of 10% per year on the non-paid amount in the case of non or late payment starting ipso jure on the date of the breach of contract and without notice. Furthermore, the Customer shall owe ipso jure a flat-rate compensation and without notice 10% of the pertinent amount, with a minimum of 25 euro per invoice.


Without prejudice to the foregoing, Geuzeshop.com is entitled to take back the unpaid or incompletely paid for articles.
